Welcome to Go Low. These Terms of Service ("Terms") constitute a legally binding agreement between you and Go Low, a DBA of Dad's Home Golf LLC ("Go Low," "we," "us," or "our"), governing your access to and use of the Go Low website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Go Low is a social platform designed for golfers. The Service enables users to create profiles, connect with other golfers, post and discover rounds of golf through our "Beacon" system, submit and view course information, leave reviews and other user-generated content, and access related features. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
We may suspend or terminate your account at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by contacting us or through account settings, where available.
Upon termination, your right to use the Service ceases immediately. We may retain or delete your account data and User Content in accordance with our Privacy Policy and applicable law. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute resolution.
You agree not to use the Service to: (a) violate any applicable law, regulation, or third-party right; (b) harass, abuse, defame, or harm another person; (c) impersonate any person or entity or misrepresent your affiliation; (d) interfere with or disrupt the Service or servers or networks connected to the Service; (e) attempt to gain unauthorized access to the Service, other accounts, or systems; (f) use the Service for any commercial purpose without our prior written consent; or (g) post content that is illegal, harmful, threatening, obscene, or otherwise objectionable. We reserve the right to remove content and suspend or terminate accounts that we determine, in our sole discretion, violate these Terms or are harmful to the Service or other users.
The Beacon feature allows users to post and discover rounds of golf ("beacons") and to request or confirm participation in those rounds.
When you post a beacon, you represent that the information you provide (e.g., course, date, time, format, stakes) is accurate. You are solely responsible for your beacons and any arrangements you make with other users. Go Low does not guarantee that any beacon will result in a round or that other users will join.
Joining or requesting to join a beacon does not create a legally binding commitment unless you and the beacon poster agree otherwise. All coordination, payment of green fees, and conduct during the round are solely between you and the other participants. Go Low is not a party to any such arrangements.
If you indicate stakes or wagers in a beacon (e.g., Nassau, skins), such arrangements are solely between you and the other participants. Go Low does not facilitate, enforce, or take any position on gambling or wagers. You are solely responsible for compliance with applicable laws in your jurisdiction regarding any stakes or wagers. We do not verify the identity, handicap, or conduct of users. You assume all risks associated with meeting and playing golf with other users and agree to exercise caution and good judgment when using the Beacon feature.
Users may submit information about golf courses for inclusion in our course database. By submitting course information, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, modify, and distribute that information in connection with the Service. You represent that you have the right to submit such information and that it does not infringe any third-party rights. We may remove or decline to publish any submission at our discretion.
You retain ownership of content you post to the Service ("User Content"). By posting User Content, you grant Go Low a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, modify, and distribute your User Content in connection with operating and providing the Service.
You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to post your User Content and that your User Content does not violate these Terms or any applicable law. We do not endorse any User Content and disclaim all liability in connection with it.
Content created in the context of a group (e.g., group rounds, group messages, or content shared within a group) may be visible to other members of that group in accordance with the group's settings. By posting in a group, you grant other group members and Go Low the rights necessary to display and use that content within the group and the Service. Group administrators may have additional controls over group content; we are not responsible for decisions made by group administrators.
We may remove or refuse to display any User Content that we believe violates these Terms or is otherwise harmful. We may also preserve and disclose User Content if required by law or to protect the rights, property, or safety of Go Low, our users, or the public.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. We may update the Privacy Policy from time to time; material changes will be posted on the Service. Your continued use after the effective date of those changes constitutes acceptance.
We respect the intellectual property rights of others and expect users to do the same. We may remove content that we believe infringes the copyright or other rights of third parties. If you believe that content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent. Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act; and (f) your physical or electronic signature. We may send you transactional and promotional emails related to the Service. By providing your email address, you consent to receive such communications. Our marketing emails comply with the CAN-SPAM Act and similar laws: they identify us as the sender, include a clear way to opt out, and honor opt-out requests promptly. You may unsubscribe from marketing emails at any time via the link in our emails or by contacting us.
The Service, including its design, features, text, graphics, logos, and software, is owned by Go Low or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service or any part of it without our prior written consent. "Go Low" and related marks are trademarks of Dad's Home Golf LLC.
The Service may contain links to or integrate with third-party websites, applications, or services. We do not control and are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms and policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GO LOW, DAD'S HOME GOLF LLC, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Go Low, Dad's Home Golf LLC, and their officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any law; or (d) your violation of any third-party right. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.
Before filing a formal dispute, you agree to contact us at support@getgolow.co and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.
If the dispute is not resolved informally, you and Go Low agree that any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding. You waive any right to a jury trial or to participate in a class action. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights. Either party may also bring an individual action in small claims court if the dispute qualifies.
We strive to make the Service accessible to users with disabilities. If you encounter an accessibility barrier or have suggestions for improvement, please contact us at support@getgolow.co. We will work with you to provide the information, item, or transaction you seek through an alternative means or to address the barrier where feasible.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date." Your continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.
These Terms, together with the Privacy Policy and any other policies we publish on the Service, constitute the entire agreement between you and Go Low regarding the Service and supersede any prior agreements, communications, or understandings.
